Sì della Camera al trapianto tra viventi

La Camera ha approvato una proposta di legge che consente il trapianto parziale di organi tra viventi. La legge, che unifica le proposte di legge Palumbo e Pagano; Binetti ed altri; Miotto ed altri, consentirà la donazione (che obbligatoriamente, per evitare fenomeni di compravendita, deve avvenire a titolo gratuito) di parti di polmone, pancreas e intestino. Ormai la scienza consente, infatti, il trapianto di parti di organi senza menomare significativamente il donatore, e a volte salvando la vita del ricevente.
Succede già in particolare per il trapianto polmonare in Usa, Giappone e sporadicamente in alcuni paesi europei. Da noi non si può per via dell’articolo 5 del codice civile, che vieta la disposizione di atti del proprio corpo “che cagionino una diminuzione permanente dell’integrità fisica”.
La legge votata dalla Camera, che passerà ora al Senato, prevede infatti la modifica di tale articolo, con le stesse precauzioni e garanzie fornite dalle leggi gia’ in vigore che consentono il trapianto di rene tra viventi.
